The Supreme Court on Sunday, January 25, issued a show-cause notice in a writ petition filed by Resham Lal Chaudhary, patron of the Nagarik Unmukti Party, challenging the Election Commission’s (EC) decision to cancel his candidacy.
A single bench of Justice Bal Krishna Dhakal also summoned both parties for a hearing on Thursday, January 29, to determine if an interim order should be issued.
Chaudhary had filed the petition on January 23, seeking to overturn the EC’s decision that annulled his candidacy from Kailali-1 for the March 5 House of Representatives election under the first-past-the-post (FPTP) system. He claimed that the election officer had acted unlawfully in rejecting his nomination and requested the court to reinstate his candidacy.
The EC had cancelled Chaudhary’s nomination on January 22, noting that although he had received a presidential pardon after being sentenced to life in the Tikapur killings case, records of the offence and imprisonment still remain on file.
